Mississippi Code Section 97-17-42 defines motor vehicle theft as willfully taking possession of or taking away a motor vehicle belonging to another person, without authority, with intent to permanently or temporarily convert it or deprive the owner of possession or ownership. A person who knowingly aids and abets the taking of a vehicle can be charged under the same statute.
The definition of “motor vehicle” is broad. It covers every self-propelled device used to transport persons or property on a highway, and extends to ATVs, off-road vehicles, farm machinery, and construction equipment. A charge doesn’t require a traditional car or truck.
Intent is a required element. The prosecution must show the accused intended to deprive the owner of the vehicle, not simply that the vehicle was used without permission in a disputed or ambiguous situation. Cases involving family vehicles, prior consent, or misunderstandings about permission can raise genuine questions about whether that intent existed. If force was involved, the conduct may fall under a separate carjacking charge rather than the motor vehicle theft statute.
Penalties Under Miss. Code Section 97-17-42

- Second or subsequent conviction: Up to $20,000 in fines and 5 to 20 years in prison, or both
- Commercial vehicle enhancement: Where the vehicle was held by a business that buys, sells, leases, rents, stores, or transports vehicles, fines up to $20,000 and 10 to 30 years in prison, or both
Courts may also order restitution covering damage to the vehicle and reasonable repair costs. For individuals with at least two prior felony convictions, Mississippi’s habitual offender statute (Miss. Code Section 99-19-81) can require sentencing at the maximum term allowed.
